CONTRACT NOTICE

Selection of Experts within the project Protecting the Civil Rights of the European Citizens – Multidisciplinary Approach, with funding from the European Commission.

Experts Description

Craiova Court of Appeal, as the Beneficiary of the project, hereby announces the initiation of a procedure for the selection of three Experts to participate in three workshops (one Expert / workshop), with the duration of 4 days, for about 25 judges, within the grant with non-reimbursable European funding named Protecting the Civil Rights of the European Citizens - Multidisciplinary Approach .

The workshops will take place as follows:

  1. In Croatia, in the period September 06th to 09th, 2016;
  2. In Germany, in the period November 01st to 04th, 2016;
  3. In Romania, in the period March, 2017.

In order to participate in the proceedings, interested persons may submit an application by e-mail to: mihail.doran@just.ro.

Prospective candidates must meet the following minimum qualification requirements:

  • Minimum qualifications and skills:
    1. 1. University degree (or equivalent) in law;
  • Minimum professional experience:
    1. At least 10 years of professional experience in the legal field (for each year of professional experience gained over the minimum requested level, an additional score shall be awarded for each year of experience, up to a maximum of 5 points).
    2. 2. Experience as a trainer or university teaching staff for at least 5 years, proven through courses or training seminars held in the field of reference (for each year of additional experience as a trainer or university teaching staff, an additional score shall be awarded, up to a maximum of 5 points).

Publication of scholarly papers in the field of reference shall receive extra points (maximum 3 points).

Delimitation of Experts shall be based on a system of points that shall be awarded as described above and considering the supporting documents submitted by them.

In order to demonstrate compliance with the requirements, tenderers shall submit their curriculum vitae (Europass format, pdf format).

The Assessment Committee reserves the right to request, during the evaluation of candidates, other documents attesting fulfilment of the professional experience requirements (certifications, certificates, references / letters of recommendation, etc.).

TENDER BOOK

for the selection of Experts for the organization of workshops on the civil rights of citizens

Craiova Court of Appeal is currently developing the project with European funding ʺProtecting the Civil Rights of the European Citizens – Multidisciplinary Approachʺ (contract no. JUST/2015/JTRA/AG/EJTR/8645).

1. Objectives

The main objective is to provide participant magistrates a multidisciplinary training in the protection of citizens’ civil rights in the light of the latest European legislative instruments adopted in the field of judicial cooperation in civil matters having cross-border implications.

The project aims the improvement of knowledge of European legislation on the protection of citizens’ civil rights, the identification of any practical difficulties in the implementation, the development of effective cooperation mechanisms between the EU Member States and the prevention of breaches, under any form, of the free movement of European Union citizens, also approached from the perspective of legal sociology.

In this context, three workshops have been designed for the intensive training of magistrates with the duration of 4 days each, with the participation of approximately 25 participants (judges).

These workshops are aimed, on the one hand, to offer specialized legal training in the field of protection measures in civil matters, in particular the Regulation (EU) no. 606/2013, but also the latest European instruments on judicial cooperation in civil matters, and on the other hand, training in legal sociology, so that judges benefit from a multidisciplinary training in the protection of civil rights of citizens in European space.

The aim of such a professional demarche, involving an exchange of experience between judges of the European Union Member States, are prerequisites for improving the quality of justice.

During the period from September 2016 to March 2017, three workshops shall be held on the topic of measures of protection of citizens’ civil rights, with the duration of 4 days, each dedicated to about 25 judges.

Workshops shall take place as follows:

  1. September 06th – 09th, 2016;
  2. November 01st – 04th, 2016;
  3. 3. March, 2017.

2. Specific Duties

Craiova Court of Appeal aims to select, in order to organize the above mentioned activities, a number of 3 Experts, namely one Expert/workshop, who shall have to meet the following obligations:

- Preparation of the event agenda, training materials and other documents needed to carry out the workshop; elaborated documentation shall be forwarded to the Project Manager by email: mihail.doran@just.ro, observing the project visibility requirements (requirements shall be communicated by the Project Manager), at least 21 days before the date of the activity;

- Participation in the workshop and lectures according to the agreed agenda, focusing on the judicial practice, in considering the quality of practitioners of participants; presentations should have a pragmatic approach, focusing on concrete issues, jurisprudence, trends at regional and international level;

- Preparation of a conference report within 14 calendar days of the date of the event, to capture the development of the conference; mandatory content elements of the report shall refer to the themes, the summary of discussions, the concerns identified and solutions proposed and any other issues that the Experts finds relevant for this purpose.

3. Profile of Experts

Experts applying for these proceedings must have a certain profile in terms of qualifications, skills and specific professional experience, necessary for carrying out the activity, as follows:

Minimum Requirements

A. General Requirements

4. Financial Offer and Payment Arrangements

The fee may be equivalent to a maximum amount of EUR 500.00 / day of workshop, under the project budget. For the fee payment, the effective provision of services contracted by each Expert shall be taken into account, payments being conditional on forwarding the following documents: application for payment (invoice), activity sheet (timesheet), conference report.

5. Procedural Issues

  • Selection of Experts

Selection of Experts shall be carried out by a committee appointed by the management of Craiova Court of Appeal, in accordance with the requirements of this Tender Book. The selection criteria are described in Section 3 Profile of Experts and consist of minimum mandatory requirements on Experts’ qualifications, skills and specific professional experience, required to implement the activity. Delimitation of Experts shall be based on a points system, which shall be awarded as described in point 3 and taking into account the evidentiary documents submitted by them.

To prove compliance with the requirements set out in point 3, the Experts shall submit their Curriculum Vitae in Europass format, and if they shall be requested by the contracting authority, the shall submit supporting documents, such as: copies of university diplomas, certifications, certificates, references / letters of recommendation from the employer or from another beneficiary, any other documents to support the allegations of the tenderer.

6. Special Terms and Conditions

  • Penalty Clause for Non-Fulfilment of Duties

In case of failure to meet the duties on each Expert under this Tender Book, or breach of any of the commitments assumed under the Agreement that Craiova Court of Appeal shall conclude with them, Craiova Court of Appeal has the right to terminate the Agreement and claim payment of damages.

The Expert shall not be held liable for breach of obligations if prevented by force majeure. The Expert shall endeavour to mitigate any damage caused by force majeure.

7. Final Provisions and Contact Details

This Tender Book shall be part of the Agreement to be concluded between Craiova Court of Appeal and selected Experts.
